Welcome to Guesty Locks Manager!
By using Guesty Locks Manager (the “Solution”), for Guesty Lite and Guesty Pro platforms (“Guesty”), you agree to the following terms and conditions (“Terms”):
1. Acceptable Use.
1.1 You will use the Solution and will not knowingly permit the use of the Solution in a manner that is not consistent with all applicable laws and regulations (including those related to privacy and security) and your agreements with third parties.
1.2 You will not use the Solution, or knowingly permit the use of the Solution in a manner that is fraudulent, unlawful, deceptive, or misleading, or in any manner harmful to, or intended to harm, any person or third party.
1.3 You are accountable for keeping your information secure. You are also liable for any activity that occurs while using the Solution, such as any changes, additions, or deletions made by you while using the Solution.
1.4 By opting into the Solution on the GLite Platform, you agree that your trial period (if applicable) will be terminated immediately, and your subscription will commence. You acknowledge and accept that you will have no claims or entitlements related to the early termination of your trial period, including but not limited to, requests for extensions, refunds, or any other forms of compensation.
2. Representations and Warranties.
2.1 We cannot guarantee that the Solution will operate without disruptions, errors, or interruptions or that it will always be accessible and free from glitches.
2.2 Without derogating from the generality of these Terms, you will bear full responsibility for the implementation of backup codes for each of your Linked End Devices and you hereby relinquish any claims, demands, or causes of action related to any losses or damages that may arise as a result of your failure to implement backup codes for your Linked End Devices. ”Linked End Device” means your end devices that are linked to the Solution via the Guesty Platform.
2.3 NOTWITHSTANDING ANYTHING TO THE CONTRARY AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GUESTY PROVIDES THE SOLUTION “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, AND NON-INFRINGEMENT. GUESTY DOES NOT GUARANTEE ANY SPECIFIC RESULTS FROM THE USE OF THE SOLUTION. GUESTY MAKES NO WARRANTY THAT THE SOLUTION WILL BE UNINTERRUPTED, FREE OF VIRUSES OR OTHER HARMFUL CODE, TIMELY, SECURE, OR ERROR-FREE. YOU USE THE SOLUTION AT YOUR OWN DISCRETION AND RISK. YOU WILL BE SOLELY RESPONSIBLE FOR (AND GUESTY DISCLAIMS) ANY AND ALL LOSS, LIABILITY, OR DAMAGES RESULTING FROM YOUR USE OF THE SOLUTION.
3. Limitation of Liability.
3.1 Guesty is not responsible for, and disclaims all liability, for any Linked End Device you use and for your, your employees, and your agents’ acts or omissions. In no event will Guesty be liable for any lost profits, or any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of, in connection with, or relating to this Terms, including the use of, inability to use, or unavailability of the Solution.
3.2 Without derogating from the generality of the above and to the maximum extent permitted by law, Guesty has no liability or responsibility for any of the following: (a) unauthorized entry or trespass or related security services, of any nature whatsoever, resulting from the use of the Solution; (b) damage, loss, or injury resulting from hacking, tampering, or other unauthorized access to, or use of, any Linked End Device or the Solution; (c) interruption of the Solution; (d) software bugs, viruses, or other harmful code that may be transmitted to or through the Solution; (e) errors, inaccuracies, or omissions of information, or any damages or losses incurred as a result of such errors inaccuracies or omissions, resulting from the use of the Solution; (f) conduct of any third party.
4. Pricing and Payment.
4.1 The fee per Linked End Device will be charged once the End Device is linked to a property and will apply for as long as the End Device remains linked to a property.
4.2 The fee will be calculated according to the following pricing grid:
| For 1-20 Linked End Devices | USD 8 per Linked End Device per month |
| For 21-50 Linked End Devices | USD 7 per Linked End Device per month |
| For 51-100 Linked End Devices | USD 6 per Linked End Device per month |
| For 101-200 Linked End Devices | USD 5 per Linked End Device per month |
| For 201-500 Linked End Devices | USD 4 per Linked End Device per month |
| For more than 500 Linked End Devices | USD 3 per Linked End Device per month |
4.3 At the beginning of each month, the Customer will be billed for the number of new Linked End Devices in the previous month, together with payment for the total number of Linked End Devices for the following month.
For example:
If a Customer joined the Solution with 3 Linked End Devices on April 15th, on May 1st, the Customer will be billed as follows:
- For the usage of April – 15 days (15/30) x 3 Linked End Devices x $8 = $12
- For the usage of May – 30 days (full month) x 3 Linked End Devices x $8 = $24
- A total of $36
4.4 No refunds will be provided for any fees already paid by the Customer and/or the disconnection of Linked End Devices before the next billing cycle.
4.5 Guesty may increase the fees at any time, at its sole discretion.
4.6 Fees are displayed in USD by default. If a Customer selects a different currency, different usage fees may apply.
5. Termination.
In addition to any remedies that may be available to Guesty under any applicable law, we may promptly temporarily or permanently suspend, or terminate your use of the Solution, if we, in our sole discretion, determine that (i) you abused your rights to use the Solution; or (ii) you materially breached these Terms; or (iii) you performed any act or omission which is harmful or likely to be harmful to Guesty, or any other third party.
6. Other terms.
6.1 Guesty may update these Terms from time to time. Your continued use of the Solution after any updates to these Terms constitutes your acceptance of the updated Terms.
6.2 Guesty’s Terms of Service, Privacy Policy and AI Use Policy are incorporated into and supplement these Terms. If there is any inconsistency between these Terms and the Terms of Service, these Terms will prevail.
