Welcome to Guesty Travel Protection! This easy-to-use solution will help your guests protect themselves against unforeseen circumstances affecting their trip before or during the scheduled dates (the “Travel Protection Solution”). By using the Travel Protection Solution, you agree to the following terms and conditions (“Terms”):
1. Acceptable Use.
1.1. You agree to use the Travel Protection Solution in compliance with all applicable laws and regulations, including but not limited to those related to insurance, privacy, and security, as well as your agreements with third parties. You will not use or knowingly permit the use of the Travel Protection Solution in any manner that is fraudulent, unlawful, deceptive, misleading, harmful, or intended to harm any person, third party, or property.
1.2. You are responsible for ensuring the security and confidentiality of your information and that of your guests. You must immediately notify Guesty of any unauthorized use of the Travel Protection Solution or any breach of security concerning guest information.
2. Third-Party Provider.
2.1. The Travel Protection Solution includes insurance services offered and provided by Arch Red Sky, a third-party provider, or any other provider at Guesty’s discretion (the “Insurance Provider“).
2.2. All insurance-related services, terms, conditions, and claims are governed solely by the Insurance Provider’s policies and agreements. By using the Travel Protection Solution, you acknowledge and agree that:
2.2.1. Guesty is not responsible for the content, accuracy, or enforceability of any insurance policies provided by the Insurance Provider.
2.2.2.Any claims, disputes, or inquiries related to insurance coverage, eligibility, or terms must be directed to the Insurance Provider, as Guesty has no authority or responsibility to resolve such matters.
2.3. Any claims or disputes regarding insurance coverage must be submitted directly to the Insurance Provider following their claims procedures.
3. Pricing and Payment.
3.1. By using the Travel Protection Solution, you agree to pay all fees specified upon sign-up and/or under your contract. No refunds will be issued for any fees once the Travel Protection process has been completed, even if the associated reservation is subsequently canceled.
3.2. Fees will be charged based on the confirmed reservation process. Monthly invoices will be calculated based on the confirmed reservation dates of the prior month.
3.3. Guesty reserves the right to modify its fees at any time, at its sole discretion, with prior written notice provided to the user.
4. Representations and Warranties.
4.1. Without derogating from the generality of these Terms, Guesty and its affiliates make no representations or warranties about the suitability, reliability, availability, timeliness, security or accuracy of the Travel Protection Solution and/or the insurance services provided by the Insurance Provider for any purpose whatsoever.
4.2. To the extent permitted by law, the Travel Protection Solution will be delivered “as is” without warranty or condition of any kind. Guesty expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, and non-infringement.
5. Limitation of Liability.
5.1. Guesty is not responsible for and disclaims all liability for any guest Travel Protection claims. In no event will Guesty be liable for any lost profits or any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of, in connection with, or relating to these Terms, including the use of, inability to use, or unavailability of the Solution.
5.2. Without derogating from the generality of the above and to the maximum extent permitted by law, Guesty has no liability or responsibility for any of the following: (a) unauthorized entry or trespass or related security services, of any nature whatsoever, resulting from the use of the Solution; (b) damage, loss, or injury resulting from hacking, tampering, or other unauthorized access to, or use of the Solution; (c) interruption of the Solution; (d) software bugs, viruses, or other harmful code that may be transmitted to or through the Solution; (e) errors, inaccuracies, or omissions of information, or any damages or losses incurred as a result of such errors inaccuracies or omissions, resulting from the use of the Solution; (f) conduct of any third party.
6. Privacy and Data Protection.
6.1. You have obtained all consents and permissions required under all applicable laws, regarding the processing, storing, collection, posting, transmission, and publication of any personal information of any person, entity, or property, and you will adhere to all laws applicable thereto.
6.2. Your use of the Travel Protection Solution does not ensure your compliance with applicable Data Protection Laws, nor is Guesty responsible for your compliance with such laws.
7. Other terms.
7.1. Insurance products are offered through Guesty Insurance Services (“Guesty Insurance”), a licensed insurance producer. Any insurance-related information is provided by Guesty Insurance for general informational purposes only and does not in any way alter or amend the terms, conditions, or exclusions of any insurance policy.
7.2. Guesty may update these Terms from time to time. Your continued use of the Travel Protection Solution after any updates to these Terms constitutes your acceptance of the updated Terms.
7.3. Some services within the Travel Protection Solution may not be available in certain jurisdictions due to local laws, regulations, or restrictions. Guesty reserves the right to modify or discontinue services in specific jurisdictions without prior notice. Users are solely responsible for ensuring that their use of the Travel Protection Solution complies with all applicable laws and regulations in their jurisdiction.
7.4. Guesty’s Terms of Service, Privacy Policy and AI Use Policy are incorporated into and supplement these Terms. If there is any inconsistency between these Terms and the Terms of Service, these Terms will prevail.
